Terms of Service

1. Acceptance

By creating an account or using MomentTrail (“the service”) you agree to these terms. If you do not agree, please do not use the service.

2. Eligibility

You must be at least 13 years old, or the minimum age set by the laws of your country, to use MomentTrail. In some jurisdictions (e.g. the EU under GDPR) the minimum age may be 16 unless a parent or legal guardian consents.

3. Your account

You sign in with Google. You are responsible for keeping your Google account secure. We will treat any action taken while signed into your account as taken by you.

4. Your content

You retain ownership of the stories, photos, voice notes, and other content you upload. By uploading, you grant MomentTrail a non-exclusive, worldwide, royalty-free licence to host, store, process (image optimisation, format conversion), display, and serve that content as required to operate the service for you and the audience you choose.

When you mark a story as Public, you also grant a licence to display it publicly on the service's Explore page. You can change visibility back to Unlisted or Draft to remove it from public discovery.

You confirm that you have the rights to upload the content you upload, including any photos or videos that include other people.

5. Acceptable use

You agree not to use MomentTrail to:

• upload or share content that is illegal, including child sexual abuse material;
• infringe anyone else's intellectual property, privacy, or publicity rights;
• spam, harass, threaten, or impersonate others;
• attempt to circumvent storage limits, upload limits, rate limits, or other technical controls;
• probe, scan, or attempt to gain unauthorised access to the service or its infrastructure;
• reverse-engineer the service except to the extent the law expressly permits.

6. Privacy

How we handle your data is described in the Privacy Policy, which is part of these terms.

7. Beta service / no warranty

MomentTrail is in early beta. The service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, secure, error-free, or that data will not be lost. Do not store irreplaceable content here.

8. Limitation of liability

To the maximum extent permitted by applicable law, MomentTrail and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service. Where liability cannot be excluded by law, it is limited to the maximum extent permitted by that law.

9. Termination

We may suspend or terminate accounts that breach these terms or that put the service or other users at risk. You may stop using the service at any time and request account deletion as described in the Privacy Policy.

10. Changes

We may update these terms. The “Last updated” date at the top will reflect the most recent change. Significant changes will be announced through the service.

11. Governing law

The governing law and dispute-resolution venue for the operating entity will be specified before public launch. During beta, please contact us first to resolve any concerns informally.
